In his witness statement to the public inquiry, the prime minister claimed that he did “not have access” to the messages during the period running the Treasury because he had changed his phone several times and failed to back them up.

So Rishi is guilty of failing to keep records in public office, that should be a sackable offense at the very least.

Failings to apply a court order is contempt.

‘Contempt of court’ happens when someone risks unfairly influencing a court case. It may stop somebody from getting a fair trial and can affect a trial’s outcome.

      Contempt of court includes:

disobeying or ignoring a court order

taking photos or shouting out in court

refusing to answer the court’s questions if you’re called as a witness

publicly commenting on a court case, for example on social media or online news articles

I don’t think this is failing to meet the court order - there are no records for him to produce. However he is supposed to be keeping records.

Not many people write a Whatsapp message to yourself. If all have been deleted then you can only assume the worst because of the obvious intent to obscure evidence.
